Terms of Service

These terms are the agreement between you and Chokedee Mechai Chokechai Mewua Soft Co., Ltd. (บริษัท โชคดีมีชัย โชคชัยมีวัวซอฟต์ จำกัด) (411/314 Pracha Uthit Road, Huai Khwang Subdistrict, Huai Khwang District, Bangkok 10310, Thailand) — “Pubrivo”, “we” — covering pubrivo.com and the Pubrivo application. Using Pubrivo means accepting them. How we handle personal data is set out separately in our Privacy Policy.

Your account

You need an account, and you must be old enough to enter a contract where you live. Keep your password to yourself: anything done through your account is treated as done by you. Tell us at [email protected] if you think someone else has access.

Workspaces and members

Work happens inside a workspace. Anyone you invite into one can see and edit everything in it, including connected channels and scheduled posts — there are no per-member permission levels, so invite accordingly. A pending invitation occupies a seat until it is accepted or withdrawn.

Plans, limits and payment

• Limits are refused, never billed. If an action would exceed your plan’s limit, Pubrivo declines it at the moment you try and tells you why. We never let you exceed a limit and then invoice you for it.
• Storage limits block new uploads and never delete anything. Going over the cap stops you adding more; it never removes what is already there.
• There is no trial, because the free plan is not one. It does not expire and needs no card.
• Paid plans are billed in advance through Stripe on a recurring basis until cancelled. Prices are shown on our pricing page, exclusive of any tax we are required to add.
• You can cancel any time. Cancellation takes effect at the end of the period you have already paid for, and we do not refund part-periods.

Downgrades, and what happens if payment fails

If you downgrade on purpose, you choose which channels keep their slots, and you remove members yourself — we will not pick a colleague to cut off on your behalf.

If a payment fails, nothing changes at first: Stripe retries the card over roughly two weeks and you keep full access throughout, with a notice in the app. If every retry fails, the subscription cancels and the workspace returns to the free plan. Because nobody chose, we then keep thethree oldest active channels and the oldest membership, disconnect the rest, and email you exactly what happened.

Disconnecting a channel — whether you do it or a downgrade does — cancels the posts still scheduled to it and stops us posting to that social account. Reconnecting the channel later restores the channel — it does not bring back cancelled posts, whose scheduled times have passed.

Your content

What you write and upload stays yours. You grant us only the permission we need to run the service: to store your content, reshape it to fit each network’s format and limits, and transmit it to the networks you selected, at the times you chose. That permission ends when the content is deleted, and it covers nothing else — we do not use your content to promote Pubrivo, and we do not use it to train anything.

You are responsible for what you publish: that you have the rights to it, and that it is lawful where it lands.

The social networks

Pubrivo publishes to networks it does not control. Each has its own terms, which apply to you directly and separately from these, and each can change its rules, its limits, or its permission to us at any time. We are not responsible for what a network does with a post once it has been delivered, for content it removes, or for an account it restricts.

YouTube. Pubrivo uses the YouTube API Services to publish on your behalf. By using Pubrivo to publish to YouTube, you agree to be bound by the YouTube Terms of Service, available at https://www.youtube.com/t/terms. Google’s Privacy Policy, at https://policies.google.com/privacy, describes how Google handles data. You can revoke Pubrivo’s access to your YouTube account at any time at https://myaccount.google.com/permissions.

Acceptable use

Do not use Pubrivo to:

• publish anything unlawful, or anything you do not have the rights to publish;
• harass, impersonate, deceive, or infringe someone else’s rights;
• send spam, or operate networks of accounts to manipulate a platform;
• break the terms of any network you connect;
• attack, probe or overload our systems, or work around a limit rather than hitting it.

We may suspend an account that does these things. Where a suspension is not urgent we will tell you first and give you a chance to fix it.

What we promise, and what we don’t

We work to keep Pubrivo running and to publish what you scheduled, when you scheduled it. But publishing depends on networks we do not operate, and they fail, rate-limit and change without notice. We cannot guarantee that a given post will be published at a given moment.When a publish fails we tell you it failed rather than pretending otherwise, and we do not silently retry in a way that could post twice.

Pubrivo is provided as it is, without warranties beyond those the law gives you and does not allow us to exclude.

Ending this agreement

You can close your account whenever you like; see Deleting your data for what we remove and when. We may end this agreement with reasonable notice, or immediately if you materially breach these terms. If we close your account without cause, we refund the unused part of anything you have prepaid.

Liability

Nothing here limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for lost profits, lost revenue, lost data, or indirect or consequential loss; and our total liability in any twelve-month period is limited to what you paid us in that period.

Changes to these terms

We may update these terms. If a change materially affects your rights we will email account holders before it takes effect. Continuing to use Pubrivo after that date means accepting the new terms; if you would rather not, cancel.

Governing law

These terms are governed by the laws of Thailand, and the courts of Thailand have jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory law where you live, or of the right to bring proceedings in your local courts.
